1. About these terms

These Terms & Conditions ("Terms") govern your use of the vvify.com website and the sale of our products to you. The site is operated by VVIFY Beauty ("VVIFY", "we", "us" or "our"), based at 128 Regent Street, London, W1B 5SA, United Kingdom.

By browsing this website or placing an order, you confirm that you accept these Terms and agree to comply with them. Please read them carefully before you order. We may update these Terms from time to time, and the version that applies to your order is the one in force when you place it.

2. Eligibility

To place an order with us you must be at least 18 years old, legally able to enter into a binding contract, and using a valid payment method that belongs to you or that you are authorised to use.

We currently sell and dispatch to addresses within the United Kingdom and the Republic of Ireland only. Orders placed for delivery outside these areas cannot be fulfilled.

3. Placing an order and when a contract is formed

When you place an order through our secure checkout, you are making an offer to buy the products in your basket. We will send you an order acknowledgement confirming that we have received your order — this acknowledgement is not acceptance of your offer.

A binding contract between you and VVIFY is formed only when we dispatch the products to you and confirm dispatch by email. If we are unable to fulfil your order — for example, because an item is out of stock or there has been a pricing error — we will let you know and will not charge you, or will refund any payment already taken.

• You are responsible for ensuring your order details and delivery address are correct.
• We may decline or cancel an order at our reasonable discretion, including where we suspect fraud or a genuine error in price or description.

4. Prices and payment

All prices are shown in pounds sterling (GBP, £) and include UK VAT where applicable. UK delivery is free. We take care to ensure prices are accurate, but if we discover a genuine error in the price of an item you have ordered, we will contact you to confirm whether you wish to proceed at the correct price before dispatch.

Payment is taken securely at checkout through our payment processor, Stripe. We accept major debit and credit cards and supported digital wallets. Your full card details are processed by Stripe and are never stored on our servers.

• Our current products are the 12-Piece Makeup Brush Set and the Flat Top Kabuki Foundation Brush (available in Pink or Black & Gold).
• The price of each product is shown on its product page and in your basket before you pay.
• Prices may change from time to time, but changes will not affect orders for which we have already confirmed dispatch.

5. Products and accuracy

We aim to describe and picture our products as accurately as possible. However, product photographs and colour swatches (such as our Pink and Black & Gold finishes) are illustrative only. The colours you see may vary depending on your device and screen settings, and minor variations between the image and the product you receive are normal.

All products are subject to availability. We may improve or update our products and packaging from time to time without notice, provided this does not materially reduce their quality.

6. Delivery

We offer free tracked delivery across the United Kingdom. Orders are dispatched within one working day, and same-day dispatch is available if you order before 2pm on a working day. Estimated delivery time is 2–4 working days from dispatch, though delivery times are estimates and not guaranteed.

Risk in the products passes to you when they are delivered to the address you provided. If delivery is delayed by an event outside our reasonable control, we will take steps to minimise the delay but are not liable for delays caused by such events.

7. Returns and cancellation

You have the right to cancel most online orders within 14 days of receiving them under the Consumer Contracts Regulations, without giving a reason. In addition, we offer a more generous 30-day returns window from the date of delivery for unused products in their original, resaleable condition.

For hygiene reasons, makeup brushes that have been used, washed or had their protective packaging removed cannot be returned unless they are faulty. This does not affect your statutory rights in respect of faulty goods. Full details of how to return an item, who pays return postage, and how refunds are processed are set out in our Refund policy.

• To cancel within the 14-day statutory period, simply let us know in writing before the period ends and return the goods promptly.
• Refunds for returned items are made to your original payment method once we have received and inspected the goods.

8. Faulty goods and your statutory rights

Under the Consumer Rights Act 2015, the products we supply must be of satisfactory quality, fit for purpose, and as described. If an item you receive is faulty, damaged or not as described, you are entitled to a remedy such as a repair, replacement or refund, depending on the circumstances.

If you believe your product is faulty, please contact us with your order number and details (and a photograph where possible) and we will put it right. Nothing in these Terms affects your statutory rights as a consumer.

9. Acceptable use and intellectual property

All content on this website — including text, images, logos, the VVIFY name and brand, product photography, graphics and page design — is owned by or licensed to us and is protected by intellectual property laws. You may view and use the site for your own personal, non-commercial purposes only.

You must not copy, reproduce, republish, distribute or exploit any part of the site for commercial purposes without our prior written permission, and you must not use the site in any way that is unlawful, fraudulent, or that could damage, disable or impair its operation or security.

10. Our liability

We do not exclude or limit our liability to you in any way where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, and for any other liability that cannot be excluded or limited under English law.

Subject to the above, we are not liable for losses that were not foreseeable, that arise from your failure to follow reasonable care instructions, or for business losses. We supply our products for domestic and private use only.

11. Governing law and contact

These Terms and any dispute or claim arising out of them or their subject matter are governed by the laws of England and Wales, and the courts of England and Wales have non-exclusive jurisdiction. If you live in another part of the UK, you may also bring proceedings in your local courts.
